1. Acceptance of Terms
By accessing or using the website located at https://www.thelemonaidproject.org/ (the “Site”), operated by The Lemon-Aid Project, Inc. (the “Organization,” “we,” “us,” or “our”), you (“you” or “User”) agree to be bound by these Terms of Use (these “Terms”), our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you must not access or use the Site.

2. About the Organization and the Site
The Lemon-Aid Project, Inc. is a California nonprofit public benefit corporation recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code. The Organization conducts its charitable programs and events in Tulsa, Oklahoma. Our mission is to empower kids of all ages to be impactful entrepreneurs and philanthropists within their community through our signature city-wide lemonade stand charity event in Tulsa, Oklahoma.
The Site provides information about our organization, programs, events, volunteer opportunities, and ways to get involved. The Site may also facilitate event registration, lemonade stand kit sign-up, volunteer sign-up, donations, and other interactions in support of our charitable mission.
3. Informational Purposes; No Professional Advice
All content on the Site, including text, graphics, images, and other materials, is provided for general informational purposes only. Nothing on the Site constitutes legal, tax, financial, or other professional advice. You should consult qualified professionals regarding any specific questions or concerns. We do not warrant that the content on the Site is accurate, complete, or current.

The Site and its entire contents, features, and functionality (including but not limited to all text, graphics, logos, images, photographs, designs, trademarks, service marks, trade names, and the “Kids Helping Kids” tagline) are owned by The Lemon-Aid Project, Inc. or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Site without our prior written consent, except that you may print or download one copy of a reasonable number of pages for your own personal, non-commercial, informational use, provided you do not modify the content and you retain all copyright and proprietary notices.
6. User-Submitted Content
The Site may allow you to submit content, including but not limited to photographs, testimonials, stories, and information provided through sign-up or registration forms (“User Content”). By submitting User Content to us, you grant The Lemon-Aid Project, Inc. a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, display, and perform such User Content in connection with our charitable mission, programs, and promotional activities, in any and all media now known or hereafter devised.
You represent and warrant that: (a) you own or otherwise control all rights to any User Content you submit; (b) the User Content is accurate and not misleading; and (c) the use of the User Content does not violate these Terms and will not cause injury to any person or entity. If User Content includes images or information about a minor, you represent that you are the child’s parent or legal guardian or have obtained appropriate consent.
7. Donations and Event Registration
7.1 Donations
Donations made through the Site are processed by third-party payment processors, Paypal and Stripe (either directly or through our third-party donor platforms, Donorbox and Donordock). We do not store your full payment card information on our servers. All donations are subject to the payment processor’s terms of service and privacy policy.
Tax-Deductibility Disclaimer: While The Lemon-Aid Project, Inc. is recognized by the IRS as a 501(c)(3) tax-exempt organization, we do not provide tax advice. The tax-deductibility of any donation depends on your individual tax situation. You should consult your own tax advisor regarding the deductibility of any charitable contribution. We will provide donation acknowledgment letters or receipts as required by law upon request. For any single contribution of $250 or more, we will provide a contemporaneous written acknowledgment containing the information required by Section 170(f)(8) of the Internal Revenue Code. For any quid pro quo contribution exceeding $75, we will provide a written disclosure statement informing you that the deductible amount of your contribution is limited to the excess of your payment over the value of any goods or services provided to you, together with a good-faith estimate of the value of such goods or services, as required by Section 6115 of the Internal Revenue Code.
7.2 Event Registration and Kit Pickup
Registration for events or lemonade stand kit pickup through the Site is subject to availability and any additional terms communicated at the time of registration. Registration does not guarantee participation in any event; we reserve the right to limit, modify, or cancel events at our discretion due to weather, safety concerns, or other factors. We will endeavor to notify registrants of any material changes.
8. Children and Minors
While our mission is focused on empowering children, the Site is not intended for unsupervised use by children under the age of 13. We expect that a parent or legal guardian will supervise any child under 13 who uses the Site and will complete any registration, sign-up, or submission activities on behalf of the child.
Parents and guardians are responsible for monitoring their children’s use of the Site. If you are under the age of 18, you should review these Terms with your parent or guardian to ensure they understand and agree to these Terms on your behalf. 9. Volunteer Sign-Up and Participation
This Section 9 governs your registration as a volunteer and your participation in volunteer activities organized or facilitated by The Lemon-Aid Project, Inc. (collectively, “Volunteer Activities”). Volunteer Activities include, without limitation, setting up and operating lemonade stands (individual/neighborhood, satellite, school, or virtual stands), staffing satellite stand locations, distributing or picking up Lemon-Aid kits, attending events (including the Kick-Off Event, TU Tailgate, or other weekend events), attending volunteer training, and any other activities undertaken in connection with the Organization’s programs and events. Volunteer registration and waiver execution are conducted through a combined online Volunteer Sign-Up and Waiver Form hosted on Google Forms (the “Volunteer Waiver”). By completing and submitting the Volunteer Waiver (either through Google or by submitted a signed copy via an alternate method), you agree to the terms of the Volunteer Waiver. For information about the personal data collected through the Volunteer Waiver — including race/ethnicity, school/organization affiliation, emergency contact information, stand type and location preferences, kit selection, training attendance, and health information — please see our Privacy Policy. To the extent any conflict exists between this Section 9 and the general Limitation of Liability (Section 12) or Indemnification (Section 13) provisions of these Terms, this Section 9 shall control as the more specific provision with respect to Volunteer Activities.
9.1 Voluntary Participation
All Volunteer Activities are entirely voluntary and undertaken at the volunteer’s own risk. Volunteers are not employees of The Lemon-Aid Project, Inc. and are not entitled to compensation, benefits, or workers’ compensation coverage. By signing up to volunteer through the Site or at an event, you acknowledge that your participation is voluntary and that you freely choose to participate.
9.2 Assumption of Risk
You acknowledge and understand that Volunteer Activities involve inherent risks, including but not limited to: handling food and beverages (including preparation, serving, allergen exposure, and foodborne illness); outdoor conditions (including heat, sun exposure, inclement weather, uneven terrain, and proximity to vehicular traffic); public interaction (including interaction with members of the public and other volunteers); use of Organization-provided materials, equipment, signage, and supplies; physical exertion; traffic and pedestrian conditions; exposure to communicable illnesses; online safety considerations (for virtual volunteers); and other risks that may be identified when signing up. YOU VOLUNTARILY ASSUME ALL RISKS OF INJURY, ILLNESS, PROPERTY DAMAGE, OR LOSS arising from or related to your participation in Volunteer Activities, whether or not caused by the negligence of The Lemon-Aid Project, Inc. or others.
9.3 Waiver and Release of Liability
TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF THE STATE OF OKLAHOMA, YOU (AND, IF YOU ARE THE PARENT OR LEGAL GUARDIAN OF A MINOR VOLUNTEER, ON BEHALF OF SUCH MINOR) HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE The Lemon-Aid Project, Inc., its directors, officers, employees, volunteers, agents, representatives, successors, and assigns (collectively, the “Released Parties”) from and against any and all claims, demands, actions, causes of action, liabilities, damages, losses, costs, and expenses (including attorneys’ fees) arising out of or relating to any injury, illness, death, or property damage sustained in connection with your participation in Volunteer Activities, REGARDLESS OF WHETHER CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF ANY OF THE RELEASED PARTIES.
Carve-Out: This waiver and release does not apply to claims arising solely from the gross negligence or willful misconduct of any of the Released Parties. This waiver and release is intended to be as broad and inclusive as permitted by Oklahoma law, and if any portion is held invalid or unenforceable, the remainder shall continue in full force and effect.
9.4 Indemnification for Volunteer Activities
In addition to the general indemnification obligations in Section 13 of these Terms, you agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys’ fees) brought by any third party arising out of or relating to your Volunteer Activities, including without limitation any claims arising from your operation of a lemonade stand, your handling or distribution of food or beverages, your interaction with the public, or your use of organization-provided materials.
9.5 Parental/Guardian Consent for Minor Volunteers
Consistent with Section 8 (Children and Minors), no person under the age of 18 may register as a volunteer or participate in Volunteer Activities without the express consent of a parent or legal guardian. A parent or legal guardian must review and accept these Terms — including, specifically, the assumption of risk (Section 9.2) and waiver and release of liability (Section 9.3) — on behalf of any minor volunteer before such minor participates in any Volunteer Activities.
By registering a minor as a volunteer through the Volunteer Waiver, the parent or legal guardian represents and warrants that: (a) they are the minor’s parent or legal guardian; (b) they have read and understand these Terms, including the waiver and release provisions; (c) they consent to the minor’s participation in Volunteer Activities subject to these Terms; and (d) they agree to be bound by these Terms on behalf of the minor, including the waiver of liability and indemnification provisions. The parent or legal guardian must complete and submit the Volunteer Waiver on behalf of the minor, thereby agreeing to the assumption of risk, release of liability, indemnification, emergency medical treatment authorization, and photograph/media release provisions contained in the Volunteer Waiver.
9.6 Photograph and Media Release
By participating in Volunteer Activities, you acknowledge and agree that The Lemon-Aid Project, Inc. may photograph, video-record, or otherwise capture your likeness, voice, and participation for the organization’s promotional, fundraising, educational, and social media purposes. You grant The Lemon-Aid Project, Inc. a non-exclusive, royalty-free, perpetual license to use such photographs and recordings in any medium, without further compensation or notice to you. Without limiting the generality of the foregoing, photographs, videos, and recordings of volunteers may be posted to the Organization’s official social media accounts, including Facebook, Instagram, LinkedIn, and X (formerly Twitter), as identified in Section 10A of these Terms.
Opt-Out: If you do not wish to be photographed or recorded, you may opt out by checking the opt-out box on the Volunteer Waiver, by notifying the event coordinator in person at the time of your Volunteer Activity, or by contacting us in writing at the contact information in Section 18 of these Terms prior to the event. For minor volunteers, the parent or legal guardian may exercise this opt-out on the minor’s behalf.
9.7 No Insurance Coverage
The Lemon-Aid Project, Inc. does not provide health, accident, liability, or any other insurance coverage to volunteers unless otherwise expressly stated in a separate written agreement. Volunteers are encouraged to maintain their own applicable health, accident, and personal liability insurance. You acknowledge that you are solely responsible for any medical expenses or other costs arising from your participation in Volunteer Activities.
9A. Tracking Technologies and California Invasion of Privacy Act Disclosure
This Site is hosted by Weebly (a Squarespace company). We have not enabled cookies, analytics tools, session replay software, chat widgets, or other tracking technologies in our Weebly site configuration. We do not use Google Analytics, Meta Pixel, or other third-party analytics or advertising tracking tools. We do not use session replay or screen-recording software (such as Hotjar, FullStory, or LogRocket) that would capture or transmit your interactions with the Site to third parties. We do not use live chat or chatbot features that transmit your communications to third-party vendors who retain independent rights to such data. This disclosure describes the Site’s configuration as of the Effective Date of these Terms. If we deploy any cookie, analytics, session-replay, chat, or similar tracking technology on the Site in the future, we will update this Section and our Privacy Policy accordingly and implement any consent mechanism required by applicable law before such technology is activated.
We do not intercept, record, or eavesdrop on your communications with the Site, and we do not use third-party vendors that retain independent rights to use your browsing data for their own purposes (such as advertising or model training). This disclosure is provided in accordance with the California Invasion of Privacy Act (Cal. Penal Code §§ 630–638). While we have not enabled tracking tools on the Site, Weebly/Squarespace, as our hosting provider, may use its own essential cookies or collect basic technical information necessary to operate, secure, and improve its hosting platform. For information about data Squarespace collects through its platform and how to manage any platform-level cookies, please refer to Squarespace’s Privacy Policy at https://www.squarespace.com/privacy.
We may host the Volunteer Waiver and other forms on Google Forms, a service provided by Google LLC. If you submit any form via Google, your data is transmitted to and processed by Google in accordance with Google’s Privacy Policy (https://policies.google.com/privacy). By submitting a form via Google, you acknowledge that your information will be processed by Google as a third-party service provider and that your submission constitutes your electronic signature and agreement to the form submitted. 10. Third-Party Links
The Site may contain links to third-party websites or services that are not owned or controlled by The Lemon-Aid Project, Inc. (e.g., social media platforms, partner charity websites, fundraising tools). We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. The inclusion of any link does not imply our endorsement or affiliation. You access third-party links at your own risk.
10A. Social Media
The Organization maintains official social media accounts on the following platforms, which constitute the Organization’s authorized social media presences:
Content posted by the Organization on its social media accounts, and content posted by third parties on the Organization’s social media pages, is subject to the separate terms of service and community guidelines of the applicable third-party platform (e.g., Meta’s Terms of Service for Facebook and Instagram) in addition to these Terms of Use.
The Organization reserves the right to moderate, remove, hide, or decline to respond to any comments, messages, or content posted on its social media pages at its sole discretion and without notice, including without limitation content that the Organization determines to be offensive, inappropriate, spam, defamatory, or otherwise inconsistent with its charitable mission.
Links from the Site to the Organization’s social media accounts are provided for convenience and informational purposes. Such links are subject to the Third-Party Links disclaimer set forth in Section 10 above. The Organization does not control the content, advertising, or functionality of any third-party social media platform.
Content posted by the Organization to its social media accounts may include photographs, videos, or recordings of volunteers and event participants, consistent with the Photograph, Video, and Media Release provisions set forth in Section 9.6 (Volunteer Sign-Up and Participation) of these Terms and the Organization’s Volunteer Waiver. Volunteers and participants who have opted out of the media release as described in Section 9.6 will not knowingly be featured in the Organization’s social media posts.
11. Disclaimer of Warranties
THE SITE AND ALL CONTENT, MATERIALS, AND SERVICES PROVIDED ON OR THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LEMON-AID PROJECT, INC. DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or other harmful components.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LEMON-AID PROJECT, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, WHICHEVER IS LESS.
13. Indemnification
You agree to indemnify, defend, and hold harmless The Lemon-Aid Project, Inc. and its officers, directors, employees, volunteers, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any User Content you submit.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Tulsa County, Oklahoma, and you hereby consent to the personal jurisdiction of such courts.
15. Modifications to These Terms
We reserve the right to modify or revise these Terms at any time, in our sole discretion. If we make material changes, we will update the “Effective Date” at the top of these Terms and may, but are not obligated to, provide additional notice (such as by posting a notice on the Site or sending an email). Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
16. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, and these Terms shall be construed as if such invalid, illegal, or unenforceable provision had never been contained herein.
17. Entire Agreement
These Terms, together with our Privacy Policy and, for volunteers, the Volunteer Waiver, Release of Liability, and Assumption of Risk Agreement (incorporated into the Volunteer Form), constitute the entire agreement between you and The Lemon-Aid Project, Inc. regarding your use of the Site and supersede all prior or contemporaneous communications, agreements, and understandings, whether oral or written, with respect to the subject matter hereof.

Volunteer Activities include, without limitation, setting up and operating lemonade stands (individual/neighborhood, satellite, school, or virtual stands), staffing satellite stand locations, distributing or picking up Lemon-Aid kits, attending events (including the Kick-Off Event, TU Tailgate, or other weekend events), attending volunteer training, and any other activities undertaken in connection with the Organization’s programs and events. Volunteer registration and waiver execution are conducted through a combined online Volunteer Sign-Up and Waiver Form hosted on Google Forms (the “Volunteer Waiver”). By completing and submitting the Volunteer Waiver (either through Google or by submitted a signed copy via an alternate method), you agree to the terms of the Volunteer Waiver. For information about the personal data collected through the Volunteer Waiver — including race/ethnicity, school/organization affiliation, emergency contact information, stand type and location preferences, kit selection, training attendance, and health information — please see our Privacy Policy. To the extent any conflict exists between this Section 9 and the general Limitation of Liability (Section 12) or Indemnification (Section 13) provisions of these Terms, this Section 9 shall control as the more specific provision with respect to Volunteer Activities.
9.1 Voluntary Participation
All Volunteer Activities are entirely voluntary and undertaken at the volunteer’s own risk. Volunteers are not employees of The Lemon-Aid Project, Inc. and are not entitled to compensation, benefits, or workers’ compensation coverage. By signing up to volunteer through the Site or at an event, you acknowledge that your participation is voluntary and that you freely choose to participate.
9.2 Assumption of Risk
You acknowledge and understand that Volunteer Activities involve inherent risks, including but not limited to: handling food and beverages (including preparation, serving, allergen exposure, and foodborne illness); outdoor conditions (including heat, sun exposure, inclement weather, uneven terrain, and proximity to vehicular traffic); public interaction (including interaction with members of the public and other volunteers); use of Organization-provided materials, equipment, signage, and supplies; physical exertion; traffic and pedestrian conditions; exposure to communicable illnesses; online safety considerations (for virtual volunteers); and other risks that may be identified when signing up. YOU VOLUNTARILY ASSUME ALL RISKS OF INJURY, ILLNESS, PROPERTY DAMAGE, OR LOSS arising from or related to your participation in Volunteer Activities, whether or not caused by the negligence of The Lemon-Aid Project, Inc. or others.
9.3 Waiver and Release of Liability
TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF THE STATE OF OKLAHOMA, YOU (AND, IF YOU ARE THE PARENT OR LEGAL GUARDIAN OF A MINOR VOLUNTEER, ON BEHALF OF SUCH MINOR) HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE The Lemon-Aid Project, Inc., its directors, officers, employees, volunteers, agents, representatives, successors, and assigns (collectively, the “Released Parties”) from and against any and all claims, demands, actions, causes of action, liabilities, damages, losses, costs, and expenses (including attorneys’ fees) arising out of or relating to any injury, illness, death, or property damage sustained in connection with your participation in Volunteer Activities, REGARDLESS OF WHETHER CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF ANY OF THE RELEASED PARTIES.
Carve-Out: This waiver and release does not apply to claims arising solely from the gross negligence or willful misconduct of any of the Released Parties. This waiver and release is intended to be as broad and inclusive as permitted by Oklahoma law, and if any portion is held invalid or unenforceable, the remainder shall continue in full force and effect.
9.4 Indemnification for Volunteer Activities
In addition to the general indemnification obligations in Section 13 of these Terms, you agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys’ fees) brought by any third party arising out of or relating to your Volunteer Activities, including without limitation any claims arising from your operation of a lemonade stand, your handling or distribution of food or beverages, your interaction with the public, or your use of organization-provided materials.
9.5 Parental/Guardian Consent for Minor Volunteers
Consistent with Section 8 (Children and Minors), no person under the age of 18 may register as a volunteer or participate in Volunteer Activities without the express consent of a parent or legal guardian. A parent or legal guardian must review and accept these Terms — including, specifically, the assumption of risk (Section 9.2) and waiver and release of liability (Section 9.3) — on behalf of any minor volunteer before such minor participates in any Volunteer Activities.
By registering a minor as a volunteer through the Volunteer Waiver, the parent or legal guardian represents and warrants that: (a) they are the minor’s parent or legal guardian; (b) they have read and understand these Terms, including the waiver and release provisions; (c) they consent to the minor’s participation in Volunteer Activities subject to these Terms; and (d) they agree to be bound by these Terms on behalf of the minor, including the waiver of liability and indemnification provisions. The parent or legal guardian must complete and submit the Volunteer Waiver on behalf of the minor, thereby agreeing to the assumption of risk, release of liability, indemnification, emergency medical treatment authorization, and photograph/media release provisions contained in the Volunteer Waiver.
9.6 Photograph and Media Release
By participating in Volunteer Activities, you acknowledge and agree that The Lemon-Aid Project, Inc. may photograph, video-record, or otherwise capture your likeness, voice, and participation for the organization’s promotional, fundraising, educational, and social media purposes. You grant The Lemon-Aid Project, Inc. a non-exclusive, royalty-free, perpetual license to use such photographs and recordings in any medium, without further compensation or notice to you. Without limiting the generality of the foregoing, photographs, videos, and recordings of volunteers may be posted to the Organization’s official social media accounts, including Facebook, Instagram, LinkedIn, and X (formerly Twitter), as identified in Section 10A of these Terms.
Opt-Out: If you do not wish to be photographed or recorded, you may opt out by checking the opt-out box on the Volunteer Waiver, by notifying the event coordinator in person at the time of your Volunteer Activity, or by contacting us in writing at the contact information in Section 18 of these Terms prior to the event. For minor volunteers, the parent or legal guardian may exercise this opt-out on the minor’s behalf.
9.7 No Insurance Coverage
The Lemon-Aid Project, Inc. does not provide health, accident, liability, or any other insurance coverage to volunteers unless otherwise expressly stated in a separate written agreement. Volunteers are encouraged to maintain their own applicable health, accident, and personal liability insurance. You acknowledge that you are solely responsible for any medical expenses or other costs arising from your participation in Volunteer Activities.
9A. Tracking Technologies and California Invasion of Privacy Act Disclosure
This Site is hosted by Weebly (a Squarespace company). We have not enabled cookies, analytics tools, session replay software, chat widgets, or other tracking technologies in our Weebly site configuration. We do not use Google Analytics, Meta Pixel, or other third-party analytics or advertising tracking tools. We do not use session replay or screen-recording software (such as Hotjar, FullStory, or LogRocket) that would capture or transmit your interactions with the Site to third parties. We do not use live chat or chatbot features that transmit your communications to third-party vendors who retain independent rights to such data. This disclosure describes the Site’s configuration as of the Effective Date of these Terms. If we deploy any cookie, analytics, session-replay, chat, or similar tracking technology on the Site in the future, we will update this Section and our Privacy Policy accordingly and implement any consent mechanism required by applicable law before such technology is activated.
We do not intercept, record, or eavesdrop on your communications with the Site, and we do not use third-party vendors that retain independent rights to use your browsing data for their own purposes (such as advertising or model training). This disclosure is provided in accordance with the California Invasion of Privacy Act (Cal. Penal Code §§ 630–638). While we have not enabled tracking tools on the Site, Weebly/Squarespace, as our hosting provider, may use its own essential cookies or collect basic technical information necessary to operate, secure, and improve its hosting platform. We may host the Volunteer Waiver and other forms on Google Forms, a service provided by Google LLC. If you submit any form via Google, your data is transmitted to and processed by Google in accordance with Google’s Privacy Policy (https://policies.google.com/privacy). By submitting a form via Google, you acknowledge that your information will be processed by Google as a third-party service provider and that your submission constitutes your electronic signature and agreement to the form submitted. The Site may contain links to third-party websites or services that are not owned or controlled by The Lemon-Aid Project, Inc. (e.g., social media platforms, partner charity websites, fundraising tools). The Organization reserves the right to moderate, remove, hide, or decline to respond to any comments, messages, or content posted on its social media pages at its sole discretion and without notice, including without limitation content that the Organization determines to be offensive, inappropriate, spam, defamatory, or otherwise inconsistent with its charitable mission.
Links from the Site to the Organization’s social media accounts are provided for convenience and informational purposes. Such links are subject to the Third-Party Links disclaimer set forth in Section 10 above. The Organization does not control the content, advertising, or functionality of any third-party social media platform.
Content posted by the Organization to its social media accounts may include photographs, videos, or recordings of volunteers and event participants, consistent with the Photograph, Video, and Media Release provisions set forth in Section 9.6 (Volunteer Sign-Up and Participation) of these Terms and the Organization’s Volunteer Waiver. Volunteers and participants who have opted out of the media release as described in Section 9.6 will not knowingly be featured in the Organization’s social media posts.
11. Disclaimer of Warranties
THE SITE AND ALL CONTENT, MATERIALS, AND SERVICES PROVIDED ON OR THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LEMON-AID PROJECT, INC. DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or other harmful components.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LEMON-AID PROJECT, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:
- Your access to or use of (or inability to access or use) the Site;
- Any conduct or content of any third party on or connected to the Site;
- Any content obtained from or through the Site; or
- Unauthorized access, use, or alteration of your transmissions or content.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, WHICHEVER IS LESS.
13. Indemnification
You agree to indemnify, defend, and hold harmless The Lemon-Aid Project, Inc. and its officers, directors, employees, volunteers, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any User Content you submit.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Tulsa County, Oklahoma, and you hereby consent to the personal jurisdiction of such courts.
15. Modifications to These Terms
We reserve the right to modify or revise these Terms at any time, in our sole discretion. If we make material changes, we will update the “Effective Date” at the top of these Terms and may, but are not obligated to, provide additional notice (such as by posting a notice on the Site or sending an email). Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
16. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, and these Terms shall be construed as if such invalid, illegal, or unenforceable provision had never been contained herein.
17. Entire Agreement
These Terms, together with our Privacy Policy and, for volunteers, the Volunteer Waiver, Release of Liability, and Assumption of Risk Agreement (incorporated into the Volunteer Form), constitute the entire agreement between you and The Lemon-Aid Project, Inc. regarding your use of the Site and supersede all prior or contemporaneous communications, agreements, and understandings, whether oral or written, with respect to the subject matter hereof.
